Criminal Litigation and Appeals 

During the course of my career since 1974, in the courts of New York State, I have successfully represented individuals charged with Murder, Manslaughter, Serious Assaults, Rape, Robbery, Arson, Burglary, Grand Larceny, Weapons Use and Possession, Sexual Abuse, Drug Sale and Possession, Welfare Fraud, Driving While Intoxicated as a felony, and Possessing Child Pornography. Also, the quashing of criminal subpoenas. In addition to countless acquittals after trial, I have negotiated countless dispositions by dismissal, and reduction of the original charges to lesser offenses of all serious felonies, as well as misdemeanor charges including Driving While Intoxicated and minor traffic violations. These reductions included favorable sentencing dispositions.

I have raised issues on appeal that affirmed dismissal of charges on double jeopardy grounds, due process violations involving charges of murder and arson, that reversed the convictions, and other due process violations. I have argued appeals in the Appellate Divisions of the Third and Fourth Department.

During the course of my career since 1988 in the Federal Courts in the Northern District of New York, United States Court of Appeals for the Second Circuit, and the Supreme Court of the United States, I have represented individuals charged with Drug Conspiracy, Drug Possession, RICO violations, Continuing Criminal Enterprises, Murder, Attempted Murder, Hobbs Act violations involving interstate robberies, Firearms Possession, and Money Laundering. In addition to some acquittals after trial, I have negotiated countless dispositions of reductions of original charges, to include dismissal and favorable sentencing outcomes. I have argued appeals before the United States Court of Appeals for the Second Circuit, and have filed three (3) writs of certiorari before the Supreme Court of the United States.

Civil Litigation and Appeals 

During the course of my career, since 1974, I have represented individuals and small businesses in litigation in the Supreme Court of the State of New York, Family Court of the State of New York, Surrogates Court of the State of New York, and the United States District Court for the Northern District of New York, and the Bankruptcy Court of the Northern District, in issues involving personal injury, wrongful death, contempt proceedings, quash subpoenas, divorce, custody, visitation,

child support and maintenance, orders of protection, child abuse and neglect, real estate claims and issues, breach of contract, insurance company disputes, mortgage foreclosure, fraud claims, will contests, and probate proceedings. In particular matters I have obtained Temporary Restraining Orders and Stays of Enforcement. I have represented individuals and small businesses in all major counties in New York, as well as many smaller counties. I have also argued civil appeals in the Appellate Division of the Supreme Court Fourth Department. In addition to litigation, and countless favorable outcomes, I have negotiated countless pre-trial dispositions of all matters with favorable outcomes for the clients.

Conclusion 

My approach has always been to negotiate a favorable disposition before or even during trial, of any criminal or civil matter. If the matter cannot be resolved, and the issue must go to trial, the client as well as I, and the witnesses are well prepared, and all necessary experts have been retained, and all necessary investigation and pre- trial discovery has been conducted. I have represented individuals and small businesses as both Plaintiff and Defendant, both Petitioner and Respondent, and clients have included lawyers.
